UNAIR Accompanies Consumer Protection Community: Discussing Air Transportation Service Standards

(5/10/2023) | Faculty of Law, Airlangga University (FH UNAIR) discussed with the East Java Consumer Protection Institute (YLPK) Foundation on Wednesday (16/8/2023). The discussions and community service carried out offline dissected the Consumer Protection Law.

The discussion entitled “Consumer Protection in Aviation Service Standards following the 1999 Montreal Convention” was attended by Drs. Muhammad Said Sutomo, Chairman of YLPK East Java. FH UNAIR also provided legal education material for aircraft consumers delivered by Adhy Riady Ararah, S.H., LL.M. (Adv.), Director of the Airlangga Institute for International Studies (AIILS) and Director of the Center for Air and Space Law (CASL).

Said explained that plane crashes that claimed consumers’ lives using aviation services did not always treat the victims the same way. The treatment of Indonesian citizen-consumers will be different from foreign citizen-consumers. Examples of cases include the Air Asia QZ8501 plane crash on the Surabaya-Singapore flight route in 2014 and the shooting incident of Malaysian plane MH17 on the Amsterdam-Kuala Lumpur flight.

This unequal treatment includes the amount of compensation received by the victim. The compensation received by Indonesian citizens tends to be lower than that of foreign consumers. Therefore, Indonesia ratified the 1999 Montreal Convention through Presidential Regulation Number 95 of 2016 so that the amount of compensation received by Indonesian citizens is the same as that of foreign citizens. However, the 1999 Montreal Convention still needs to be implemented in Indonesia.

The difficulty in implementing this occurs because the provisions of national law, namely Aviation Law Number 1 of 2009 and its derivative regulations regarding compensation, were made when Indonesia was not yet a party to the 1999 Montreal Convention. As a result, many provisions in national law conflict with the requirements of the 1999 Montreal Convention, not only the amount of compensation but also related to the principles of legal enforcement. This legal dualism causes the protection of consumers using air transportation services in Indonesia to be hampered, and many are not implemented. Air transportation plays an essential role in advancing national tourism. In addition, consumers’ ignorance of the rights of users of air transportation services following the provisions of the 1999 Montreal Convention will have an impact on low bargaining power in negotiating the amount of compensation.

International Law Department Community Service: Empowering of Women’s Groups Through Sustainable Processed Banana Products

(23/9/2023) |  Airlangga University Faculty of Law (FH UNAIR) continues to expand its role in contributing to society through community service activities as part of efforts to advance community and support local economic empowerment. On Saturday, September 23, 2023, FH UNAIR held a community service program in Jambuwer Village, Kromengan District, Malang Regency. This activity empowers women’s groups in Cakru’an Klopo Kuning through sustainable banana processing products.

This community service program involved 30 enthusiastic village residents who took part. One of the village residents who took part was Mrs. Riono, owner of a typical village banana chip business with the brand “Arca,” the village’s flagship product.

The main problem identified in the development of a processed banana product business in this village is related to marketing and product packaging. The traditional marketing that village residents have carried out still needs to be improved to reach a more extensive market share.

Apart from that, the product packaging currently owned by Mrs. Riono with its superior banana product, namely “Arca,” is still too simple, so improvements are needed in the product packaging so that it can be the key to attracting consumer interest and increasing competitiveness in a competitive market like today.

The community service team is led by FH UNAIR International Law lecturers Dr. Nilam Andalia Kurnasari, Masitoh Indriani, and Adhy Riadhy Arafah. Also participating in this activity were the Head of the International Law Department, Prof. Koesrianti, Vice Dean I for Academic Affairs, Dr. Enny Narwati, Head of the Master of Law Program, Dr. Aktieva Tri Tjitrawati, and Dr. Intan Inayatun Soeparna and Dr. Lina Hastuti, all of whom are lecturers from the International Law Section of FH UNAIR.

In addressing the two main issues mentioned, this community service found a solution, namely the digitalization of marketing or online markets, improving product packaging with more environmentally friendly packaging, and adding information to the packaging. Increasing knowledge and skills regarding online marketing are expected to help women’s groups market processed banana products more effectively and efficiently. Apart from that, improvements to product packaging are expected to increase the competitiveness of “Arca” products on the market, and not only for chips, Jambuwer Village also has delicious coffee products that the wider community should enjoy.

Prof. Koesrianti said, “We hope that through this community service activity, the women’s group in Jambuwer Village can continue to develop the business of products sustainably produced by village residents and compete in an increasingly competitive market.”

FH UNAIR will continue to support and oversee this empowerment process so that village communities can experience tangible benefits from this effort. Similar programs can continue to be carried out to empower communities in various regions to achieve better prosperity.

UNAIR Faculty of Law International Law Department Continue Community Service Activities: Strengthen Urban Community Economic Resilience

(July 27, 2022) | Community service is an activity that aims to help specific communities in several activities, of course, without expecting anything in return. Community service is one of the pillars of the Higher Education Tri Dharma, designed to make a real contribution to society. In addition to community service, the Tri Dharma of Higher Education requires university academics to conduct education and research.

The International Law Section of the Faculty of Law, Universitas Airlangga (FH UNAIR) conducted community service activities with the Elok Mekar Sari Farmers Group in Semolowaru, Surabaya. This activity is the second community service activity carried out by the International Law Department. The training was held on July 26, 2022, and aims to strengthen the economic resilience of urban communities through processed mushroom products made by the Elok Mekar Sari Farmer Group.

The COVID-19 pandemic that hit the world has caused the world economy to fall, especially the Micro, Small, and Medium Enterprises (MSMEs) sector. Many entrepreneurs have bankrupted companies that have laid off their employees to save the budget. With community service, academics visit villages to help improve the village economy, which was hampered due to the COVID-19 pandemic.

The International Law Department of FH UNAIR sees an opportunity from the Food Security Strengthening Service in the City Government of Surabaya. This opportunity would not have materialized if various layers and parties did not assist it, so FH UNAIR is here to help maximize the potential of the Surabaya City Government’s Food Security Strengthening Agency in carrying out their duties to help villages improve their economy. FH UNAIR also helps facilitate farmer groups in Surabaya to optimize their agricultural business so that their economy is no longer oppressed.

UNAIR Faculty of Law also helped to provide insight regarding farmer groups in urban areas through discussions with the Elok Mekar Sari Farmer Group by inviting experts in their fields. The activity began with remarks from the head of the local Rukun Warga (RW). He expressed his gratitude to FH UNAIR for helping the business of farmer groups in urban areas.

The following welcome came from the head of the Elok Mekar Sari Farmers Group, Made. Made said the Elok Mekar Sari Farmers Group’s business development innovations, such as processing mushrooms for production and consumption at home, would be fully supported by the Food Security Service of the East Java Provincial Government.

The event continued with remarks from the head of the International Law Section of FH UNAIR, Prof. Koesrianti, S.H., LL.M., Ph.D. Prof. Koesrianti said that community service activities carried out to help urban farmer groups were a good innovation because usually, community service activities were only carried out in villages, so urban areas were left untouched. Many business actors in urban areas, such as MSME players, also need support and encouragement. The COVID-19 pandemic that occurred has not only made the village economy worse off but the city economy as well. Therefore, the City Government is here to help maximize the potential of businesses in urban areas, such as the potential of the Elok Mekar Sari Farmers Group.

Further remarks came from representatives of the Food Security Service. He explained that there would be certification for food security and assessments and competitions for farmer groups in urban areas.

Several preparations are usually made for processed mushrooms made by the Elok Mekar Sari Farmers Group. Made said the Elok Mekar Sari Farmers Group has a production house called the Mushroom House to process these mushrooms.

“The mushrooms harvested at Elok Mekar Sari are made into several preparations, namely mushroom satay, mushroom tofu, mushroom dumplings, mushroom bread, mushroom pizza, and many others. And all of them are processed; the harvest is not sold raw,” said Made.

The event was closed by handing over certificates to the Elok Mekar Sari Farmers Group by representatives of the Surabaya City Government. This certificate is a form of appreciation for the efforts of the Elok Mekar Sari Farmers Group in mushroom processing.

Community Service of PSHK EBT FH UNAIR: Optimizing Environmental Education Tourism Villages through Waste Sorting

(28/7/2022) | One of the main elements of the Reformation era is the distribution of development in Indonesia. Therefore, it is only possible to discuss equity efforts by discussing efforts to empower villages and place villages as pillars of development. One of its manifestations is how village economic growth can be stimulated by sustainable tourism, where the guidelines for the direction of movement have been covered by Regulation of the Minister of Tourism and Creative Economy Number 9/2021.

From there, the Center for New and Renewable Energy Law and Policy Studies (PSHK EBT) FH UNAIR saw the need for collaboration and assistance for villages in developing their capabilities to create Green and Sustainable Tourism Villages. This premise underlies the community service carried out by PSHK EBT FH UNAIR in Gunung Sari Village, Madiun Regency. In carrying out this activity, PSHK EBT FH UNAIR also collaborated with the Administrative Law Section of FH UNAIR.

The theme of this community service is “Community Empowerment through Waste Sorting in the Context of Optimizing Environmental Education Tourism Villages in Gunungsari Village – Madiun Regency.” The village is one of the villages that has developed sustainable principles in its tourism objects, such as the Pundensari Market. Even so, people’s understanding of waste management must be improved to support these sustainable principles.

In the counseling, which was held on Saturday morning (23/7/2022) which was held at the Pundensari Market Hall, PSHK EBT presented two speakers. The first is Professor of Administrative Law UNAIR Prof. Tatiek Sri Djatmiati, who gave material related to the role of the village government towards green tourism. There, Prof. Tatiek explained four principles that must be present in sustainable tourism development.

“The four pillars are sustainable management, sustainable economy, cultural sustainability, and sustainable environment. These pillars are the basis for forming a green tourism village,” said Prof. Tatiek.

The second speaker in the counseling was the Head of PSHK EBT FH UNAIR Indria Wahyuni, Ph.D., who focused on increasing public understanding of waste, types of waste, and how to manage waste. Indria emphasized that approximately 175,000 tons of waste are disposed of in Indonesia every day. Thus, waste management is a crucial issue not only for Gunungsari Village but for the national realm. Waste management from a minor level (household) and in village areas is expected to reduce the accumulation of waste at landfills (TPS) and final disposal sites (TPA).

“Waste management activities are also expected to provide economic value to the community by reusing recycled waste, which can be transformed into various other forms. Waste that has been sorted can also be used in other economic forms, such as magot cultivation, and produces clean energy based on waste,” said the Energy Law Expert.

Indria also explained material related to the types of waste, precisely the kinds of plastic waste around people’s daily lives. This is given to ensure increased public understanding of the importance of 3R (reduce, reuse, recycle). FH UNAIR carried out this community service to embody the Sustainable Development Goals (SDGs) No. 12, which focuses on responsible consumption and production.

Community Service of UNAIR Master of Notary Program: Emphasizes the Importance of Registration of Land Rights

(July 29, 2022) | Cases of disputes regarding the ownership of land rights are a widespread issue. This problem regarding ownership of land rights occurred because, before the enactment of Law Number 5 of 1960 concerning Basic Agrarian Regulations (Basic Agrarian Law), there was no certificate governing a person’s ownership of land rights. The government pays special attention to cases of land rights disputes to provide legal certainty for the community. To encourage the creation of legal certainty for the community, the community can register their land with the authorized institution. Land registration is a series of activities carried out by the government continuously, continuously, and regularly, covering the collection, processing, bookkeeping, and presentation and maintenance of physical data and juridical data in the form of maps and lists of land parcels. Regulations regarding land registration are regulated in the Basic Agrarian Law. The Basic Agrarian Law is a compelling legal regulation for all land-related matters.

The Notary Masters study program, in collaboration with the Notary Masters Student Association at Airlangga University, held community service activities on Thursday, July 20, 2022, in Wedani Village, Gresik Regency, with the theme “Providing Counseling and Assistance on Community Land Rights in Wedani Village.” This community service activity is carried out to uphold the pillars of the Tri Dharma of Higher Education. This activity is a series of counseling and legal assistance events aimed at public education for the residents of Wedani Village.

The event was opened with remarks by the Head of the Notary Masters Study Program, Dr. Indira Retno Aryatie, S.H., M.H., and continued with remarks by the Head of Wedani Village, H. Sanjaya. In his speech, the Head of Wedani Village said he hoped that the results of this activity could provide awareness, especially for the people of Wedani Village, to immediately register their land to obtain legal certainty and legality for the land they occupy.

After the remarks, there was a presentation of material by Dr. Agus Sekarmadji, S.H., M.Hum as an expert on land law and a lecturer at the Faculty of Law, Airlangga University. He delivered material on Basic Agrarian Law to foster legal education for the residents of Wedani Village. Agus explained that since 1960 the Basic Agrarian Law had encouraged people to register their land rights so that people had certificates that could be used as evidence as stipulated in Article 32 paragraph (1) of Government Regulation 24 of 1997.

“The Basic Agrarian Law since 1960 has provided recommendations for land registration. The benefit of doing land registration yourself is that people get certificates. This certificate can be used as proof of rights. If there is a dispute, the certificate can be used as proof of legal ownership,” said Agus.

Agus also said that certificates can be used as collateral for debt. In addition, he continued people who have land ownership certificates can increase the value of the land they occupy because the price of land that already has a certificate will be higher than that of land that does not yet have a certificate.

Finished the material presentation session is a question-and-answer session. The Head of Wedani Village also asked about the eigendom land a Wedani Village resident owned. Agus explained that, especially for eigendom land, you need to be careful because the type of soil is different from the usual soil. Eigendom means the absolute right to an object, property, or property of a person. Eigendom land or eigendom depending was a product of land law during the Dutch colonial era in Indonesia, which stated a person’s land ownership. A person who owned eigendom land in ancient times must convert his land rights no later than twenty years after the Basic Agrarian Law was promulgated. Eigendom land originates from the Western civil law system, while the Basic Agrarian Law is the national agrarian law. However, until now, many people still need to take care of converting their eigendom lands into certificates.

“When it comes to eigendom lands, we have to be careful. Referring to the Basic Agrarian Law, we must know whose eigendom land belongs to. If an individual owns it, then according to the current provisions, the land should have become state-owned land,” he explained.

Furthermore, he explained that, in essence, the eigendom land owned by one of the residents of W Village Edani and may not be traded to other people because the status of the eigendom land is state-owned land. If the land is to be traded, it must apply rights to the land by providing primary proof of ownership.

“Hopefully, with this counseling and legal assistance event, the people of Wedani Village will be moved to immediately register their land ownership at the Gresik Regency Land Office as a place that provides land registration services to obtain legal certainty. Hopefully, after this event, people will be more aware of the importance of land registration,” Agus concluded.

Community Service: HRLS’ Commitment to Realizing Equitable Education in Surabaya

Education, which is identical to learning activities, is not always carried out in the classroom. Given that students also need to participate in various extracurricular activities. Due to the limitations of teachers, each school requires extracurricular instructors and trainers who can intensively accompany their students in developing interests and talents that can later produce achievements or even provisions for their future lives. However, various problems often befall extracurricular instructors and trainers, especially in the city of Surabaya, which have an impact on the non-fulfillment of constitutional rights in the form of work and a decent living for humanity as mandated by Article 27 paragraph (2) of the 1945 Constitution of the Republic of Indonesia. These problems include wages that are only paid for 11 (eleven) months in 1 (one) year with wages given every 3 (three) months, no work contracts, and many more.

As an effort to fight for their constitutional rights, extracurricular instructors and trainers agreed to join and form an association called the Surabaya Extracurricular Coaches and Trainers Community (KOPTRAS). However, the association does not yet seem to have the status of a legal entity that can strengthen KOPTRAS’s bargaining position. Therefore, the Faculty of Law of Airlangga University through the Center of Human Rights Law Studies (HRLS) held a community service activity to strengthen the KOPTRAS institution. The main title of the activity was “Strengthening the Institution of the Surabaya Extracurricular Coach and Mentor Community (KOPTRAS) in Realizing a Just Educational Environment”. The activity, which was held on Tuesday, December 7, 2021, presented two competent speakers in their fields to explain the stages of registering a legal entity for the association. As an opener, Franky Butar Butar S.H., M.Dev. Prac., LL.M., as the Director of HRLS, said that extracurricular coaches and trainers have an important role in producing the next generation of the nation. The first presentation of material was delivered by Dian Purnama Anugerah, S.H., M.Kn., LL.M with the main material around the Articles of Association of the association’s legal entity. The presentation of the material did not seem to be only done in one direction, but the participants in groups were also invited directly to discuss the main points that must be included in the Articles of Association of the legal entity of the association, such as Name, Domicile, Purpose, Objectives, Functions, Rights and Obligations of Members, Association Organs, Attributes, Management, and Association Finances.

The second presentation of the material was delivered by Rika Pertiwi, S.H., M.Kn. as a notary domiciled in Gresik. She explained that the registration of the legal entity of the association is carried out electronically using the legal entity administration system organized by the Directorate General of General Legal Administration of the Ministry of Law and Human Rights. There are several formats that must be prepared, including the format for submitting the use of the name, the format for establishment, and the format for approval of the articles of association. In closing, Masitoh Indriani S.H., LL.M., as the head of the community service program, expressed her commitment to continuing to assist KOPTRAS in the future through various activities. He also hopes that KOPTRAS can soon have a legal entity status so that in the future it can produce various works for better education in Surabaya.

Pengabdian Masyarakat Bagian Hukum Internasional FH UNAIR: Semangat Berkelanjutan Dalam Berdayakan Nelayan Perempuan Kenjeran

Humas (29/10/2021) | Dalam rangka mengamalkan aspek ketiga dari Tridharma Perguruan Tinggi, Bagian Hukum Internasional menggelar pengabdian masyarakat pada Jumat (15/10/2021) di Kelurahan Kedung Cowek, Kecamatan Bulak, Kota Surabaya. Target dari pengabdian masyarakat ini adalah pemberdayaan nelayan-nelayan perempuan di wilayah tersebut.

Perspektif women empowerment ini digunakan untuk memberi kemampuan bagi para nelayan perempuan untuk lebih berdikari dalam sektor ekonomi kreatif. Hal ini guna membangkitkan keterpurukan ekonomi rumah tangga akibat merebaknya pandemi COVID-19. Beberapa kegiatan pemberdayaan ini adalah membuat produk pangan hasil olahan dari bahan perikanan. Beberapa contohnya adalah membuat abon lele, nugget lele, tahu bakso ikan, peyek jangkrik, dan sate jamur. Harapannya produk ini dapat dijual belikan oleh para nelayan perempuan tersebut. 

Selain makanan laut, Bagian HI juga memberdayakan sektor unit usaha simpan pinjam. Hal ini berguna pula dalam upaya membingkai identitas wilayah Kelurahan Kedung Cowek sebagai sentra penghasil abon lele yang lezat. Peningkatan taraf hidup ini esensial dalam mengurangi disparitas sosial dan angka kemiskinan di wilayah tersebut. Warga setempat merasa senang dengan kehadiran kegiatan pengabdian masyarakat ini, karena kegiatan ini dapat mentransfer ilmu pengetahuan baru yang sebelumnya tak diketahui oleh para nelayan perempuan disitu.

Yang unik juga dari kegiatan ini adalah peran pemberdayaan sesama perempuan semakin terasa karena juga melibatkan Kelompok Tani Elok Mekar Sari Kelurahan Semolowaru Surabaya. Kelompok Tani ini merupakan salah satu kelompok tani langganan berbagai kejuaraan tentang ketahanan pangan yang diadakan oleh Pemerintah Kota Surabaya. Kelompok Tani ini juga sekaligus menjadi mentor bagi para nelayan dari daerah Kenjeran untuk sharing pengalaman pengelolaan kelompok dan komunitasnya.

Dr. Koesrianti, Ketua Bagian HI yang juga koordinator dalam sesi wawancara terpisah mengatakan bahwa program ini akan menjadi program jangka panjang Bagian HI. “Kami ingin membantu para nelayan perempuan daerah Kenjeran dengan harapan kedepan akan menjadi Desa atau Komunitas Binaan dari Bagian HI, sehingga keberlanjutan program pengabdian ini benar-benar akan diterima manfaatnya oleh masyarakat. Masyarakat Kenjeran ini sangat dekat dengan kita, dengan universitas kita, menjadi kewajiban dan tanggung jawab kita untuk membantu dan memberdayakan mereka.”

Pengabdian Masyarakat Bagian HTN Fakultas Hukum Universitas Airlangga Fokuskan Pada Kiat-Kiat Perumusan Peraturan Desa

Humas (26/10/21) | Lagi-lagi, Universitas Airlangga mengajukan bukti nyata bentuk pengamalan Tri Dharma Perguruan Tinggi. Pada hari Jumat (22/10), giliran Bagian Hukum Tata Negara Fakultas Hukum mengadakan Pengabdian Masyarakat (Pengmas) bekerja sama dengan Pemerintah Desa Ngrimbi dan Pengurus Anak Cabang Pemuda Ansor Kecamatan Bareng. Pengmas kali ini dilangsungkan di Desa Ngrimbi, Kecamatan Bareng, Kabupaten Jombng, dengan mengusung tema ‘Pendampingan Pembuatan Peraturan Desa yang Partisipatif Dalam Rangka Mewujudkan Demokrasi Inklusif di Desa Ngrimbi’. Sejumlah kurang lebih 50 peserta terlibat dalam kegiatan ini. Para peserta tersebut berasal dari berbagai institusi di desa yang meliputi perangkat desa, Badan Permusyawaratan Desa, Rukun Tetangga, Lembaga Permusyawaratan Masyarakat Desa, serta tokoh masyarakat atau agama.

Kegiatan ini didasari atas masih kurangnya pemahaman teknis terkait dengan pembentukan produk hukum yang ada di desa. Perangkat desa dan masyarakat desa dirasa belum memahami sepenuhnya mekanisme pembentukan peraturan desa, terlebih teknik perancangan peraturan desa. Oleh karena itu, Bagian Hukum Tata Negara Fakultas Hukum Universitas Airlangga menghadirkan tiga narasumber yaitu M. Burhanuddin yang memaparkan mengenai peran organisasi masyarakat dalam membuat kebijakan di desa. Kemudian dilanjutkan oleh Dri Utari Christina Rachmawati, S.H., LL.M selaku Ketua Bagian Hukum Tata Negara yang menjelaskan tentang struktur pemerintahan desa. Dalam paparannya, beliau menegaskan tentang pentingnya pemerintahan desa dalam pelayanan publik. Selain itu dijelaskan pula mengenai gambaran aparatur desa yang ideal. Menurut Dri Utami, potret aparatur desa yang ideal adalah yang memenuhi kriteria 4C; concept, competence, consistent dan commitment.

Sebagai penutup, narasumber utama Pengmas kali ini, Ekawestri Prajwalita Widiati, S.H., LL.M selaku Dosen Hukum Tata Negara Universitas Airlangga, menuturkan lebih lanjut mengenai kesalahan umum yang terjadi dan ketidakcermatan dalam perumusan peraturan desa. Dalam peraturan desa seringkali tidak ditemukan perumusan norma yang memuat subyek norma, objek norma, operator norma secara tepat. Untuk itu beliau memberikan kiat-kiat dalam perumusan peraturan desa agar kesalahan serupa tidak terjadi di kemudian hari. Selanjutnya selain paparan dari narasumber, kegiatan ditutup dengan sesi tanya jawab. Beberapa pertanyaan dilontarkan oleh para peserta, diantaranya mengenai kekhawatiran dari perangkat desa jika nanti peraturan yang dibuatnya tidak sesuai dengan arahan kecamatan dan desa lainnya. Sebagai indikator keberhasilan kegiatan ini, Bagian Hukum Tata  Negara juga mengadakan pre-test dan post test. Hasilnya, pengetahuan sebagian besar peserta menjadi bertambah setelah kegiatan Pengmas ini.

Humas (10/10/21) | Berlakunya Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nomor 1 Tahun 2021 tentang Sertifikat Elektronik (PMA 1/2021) merupakan wujud moderinasasi dalam administrasi pertanahan sebagai sarana untuk memberikan kemudahan akses pelayanan pertanahan bagi masyarakat. Oleh karenanya, sebagai bentuk pengabdian kepada masyarakat dalam rangka untuk meningkatan kesadaran hukum, Fakultas Hukum Universitas Airlangga bekerjasama dengan Universitas Tulungagung menyelenggarakan sosialisasi kepada Masayarakat Desa Kaligentong, Tulungagung tentang pelaksanaan PMA 1/2021.

Kegiatan yang bertajuk “Sosialisasi Pendaftaran Tanah Secara Elektronik Demi Mewujudkan Kepastian dan Perlindungan Hukum” tersebut, dilaksanakan pada hari Rabu, 28 Juli 2021 melaui Zoom Cloud Meeting. Selain ditujukan kepada masyarakat Desa Kaligentong, sosialisasi tersebut juga ditujukan kepada praktisi dan akademisi hukum yang bergerak dibidang pertanahan, seperti Notaris dan Mahasiswa. Selain itu, Pengabdian masyarakat ini tidak hanya bertujuan untuk mensosialisasikan apa itu sertifikat tanah, namun juga bertujuan untuk meningkatkan kesadaran masyarakat tentang pentingnya aspek legalitas dalam pertanahan.

Acara dimulai pukul 09.00 WIB dengan dipandu oleh Retno Sari Dewi, S.H., M.H., sebagai moderator. Kesempatan untuk menyampaikan materi pertama diberikan kepada Dr. Agus Sekarmadji, S.H., M.Hum, selaku akademisi di bidang hukum pertanagan. Selama kurang lebih 45 menit, beliau menyampaikan materi seputar dasar secara normatif sertifikat tanah sebagai legalitas tanah dan perbedaan sertifikat analog dengan sertifikat elektronik. Menurut beliau, sertifikat elektronik akan membantu masyarakat untuk mendapat kepastian hukum, karena bidang tanah akan terdata pada sistem digital. Sistem inilah yang mengurangi kemungkinan terjadinya tumpang tindih hak atas bidang tanah yang sama. Sebagai bukti kepemilikan tanah, masyarakat nanti akan diberikan tanda bukti berupa dokumen elektronik yang memuat QR Code sebagai kode verifikasi. Beliau juga menambahkan bahwa dalam masa peralihan, masyarakat yang telah mendapat sertifikat analog tidak perlu khawatir karena pembuktiannya masih berlaku. Hadirnya sertifikat elektronik seolah-olah memberikan opsi tambahan kepada akan alat bukti hak atas tanah yang sah. Sebagai penutup, beliau menegaskan bahwa sertifikat merupakan bukti terkuat atas kepemilikan bidang tanah.

Kesempatan berikutnya diberikan kepada Khoirul Anam, S.Sy., M.H.I. untuk menyampaikan materi seputar sengketa pertanahan dari perspektif akademisi dan praktisi hukum. Beliau berpendapat bahwa sengketa pertanahan dapat terjadi karena adanya penyerobotan tanah oleh oknum yang memiliki akses adimintrasi pertanahan. Hal ini tentu saja menimbulkan kerugian pada pihak yang tidak memiliki akses adiministrasi pertanahan. Oleh karenanya, peningkatkan kesadaran masyarakat tentang legalitas tanah miliknya dapat menjadi jalan untuk menyelesaikan dan mengindari timbulnya sengketa pertanahan. Sejatinya, konstitusi menghendaki bahwa air, bumi, angkasa, dan seluruh isinya dikuasai oleh Negara untuk kemakmuran seluruh rakyat Indonesia, bukan hanya segelintir kalangan saja. Beliau juga menyampaikan bahwa dalam menyelesaikan sengketa pertanahan diperlukan ketelitian dari semua pihak untuk memahami akar masalah. Apakah permasalahan terjadi pada administrasi, atau malah pada proses peralihan tanah, misalnya.

Pengabdian Masyarakat: FH UNAIR Beri Dukungan Dalam Pengelolaan Dana Desa Guna Menghindari Maladministasi dan Korupsi

Humas (11/10/21) | Desa merupakan ujung tombak dalam pembangunan Indonesia. Berbagai program untuk mendukung pembangunan desa telah dilakukan oleh Pemerintah. Salah satunya adalah dengan menyediakan anggaran dana desa yang dapat digunakan sesuai dengan kebutuhan desa dan dikelola secara efektif, efisien dan bertanggung jawab oleh masing-masing desa. Selain itu, desa juga perlu untuk mendapatkan dukungan dari pemerintah pusat dan pemerintah daerah berupa pendampingan agar para aparat desa yang mengelola dana tersebut tidak terkena jerat hukum terkait maladministrasi dan bahkan korupsi.

Dalam merespons hal tersebut dan sebagai bentuk nyata pengabdian kepada masyarakat, Bagian Hukum Administrasi Fakultas Hukum Universitas Airlangga menyelenggarakan penyuluhan di Desa Pulo Lor, Kabupaten Jombang. Kegiatan yang diselenggarakan pada Jumat, 17 September 2021 bertujuan untuk memberikan pemahaman terkait pengelolaan dana desa kepada masyarakat, khususnya kepada aparat desa. Bertempat di Balai Desa Pulo Lor, pengabdian masyarakat tersebut mengangkat tema “Pendampingan BUMDesa dalam Pengelolaan Keuangan dan Aset Desa berbasis Kewenangan Lokal Berskala Desa di Desa Pulo Lor Kabupaten Jombang”.

Hadir sebagai pembicara yaitu dua dosen Fakultas Hukum Universitas Airlangga yang berpengalaman di bidangnya. Kesempatan pertama untuk menyampaikan materi diberikan kepada Prof. Tatiek Sri Djatmiati, S.H., M.S dengan tajuk “Eksistensi Badan Usaha Milik Desa (BUMDes) untuk Meningkatkan Kesejahteraan Masyarakat”. Prof Tatiek, sapaan akrab beliau, mengatakan bahwa keberadaan BUMDes (Badan Usaha Milik Desa) sangat penting bagi masyarakat dan pemerintahan desa dalam rangka mendukung peningkatan perekonomian masyarakat desa. Hal ini terkait dengan dukungan terhadap tujuan pemerintahan negara yaitu untuk meningkatkan kesejahteraan masyarakat sebagaimana diamanatkan oleh UUDNRI 1945 yang tercantum dalam pembukaan Alinea V. Berkaitan dengan tujuan yang penting bagi pembentukan Badan Usaha Milik Desa tersebut, kiranya perlu dipertimbangkan upaya – upaya yang harus ditempuh untuk meningkatkan peran BUMDesa sehingga benar–benar memiliki peran dalam peningkatan kesejahteraan bagi masyarakat dan pemerintahan desa.

Kesempatan selanjutnya diberikan kepada Dr. Emanuel Sujatmoko, S.H., M.S. yang mengajak para peserta berdiskusi tentang Pembentukan Badan Usaha Milik Desa (BUMDes). Pak Jat, sapaan akrab beliau, memulai paparannya dengan dasar hukum, kewenangan dan tujuan adanya BUMDes. Beliau juga turut membahas tentang pendirian, penyertaan modal dan jenis usaha yang boleh dijalankan oleh BUMDes.

Pengabdian masyarakat ini mendapatkan apresiasi dan atensi yang tinggi dari masyarakat. Tercatat sekitar 30 masyarakat Desa Pulo Lor yang hadir dan sangat antusias mengikuti diskusi dari awal sampai akhir. Peserta juga aktif bertanya terkait hal teknis pengelolaan dana desa dan BUMDes. Sebagai penutup, para pembicara dan dosen juga mempersilahkan para peserta diskusi untuk dapat berkonsultasi jika menemui permasalahan dalam pengelolaan dana desa dengan memberikan masing-masing kontak yang dapat dihubungi sehingga silaturahmi bisa masih terus berlanjut.
