UVA Lecturer Discusses Issues and Developments in Digital Property Transactions

FH News (09/04/2026) | Digital transformation is now changing not only the way people communicate, but also the way the law works. This was the main focus of the Global Law Lecture Series at the Faculty of Law, Airlangga University, when Dr. Bart Jansen from the University of Amsterdam presented “Digital Property Transactions & E-Consent.”

In this interactive and insightful session, Dr. Bart invited students to understand how property transactions are shifting to the digital realm. The transfer of land, assets, and even intellectual property rights is no longer always done physically, but through electronic platforms that require sophisticated security and verification systems.

Equally important, he highlighted the concept of e-consent, an agreement given digitally through a click, electronic signature, or biometric verification. While seemingly simple, Dr. Bart emphasized that its validity must still comply with basic legal principles, such as free will and complete understanding of the parties.

This change also impacts the role of notaries. While previously synonymous with physical presence and written documents, notaries are now required to adapt to electronic notarization practices to ensure legal certainty amidst the digital age.

Interestingly, Dr. Bart also compared Indonesia’s and the Netherlands’ preparedness in facing this era. The Netherlands is considered to have a more mature digital legal system, while Indonesia is still in the process of developing adequate regulations and infrastructure.

Through this lecture, UNAIR Faculty of Law students not only gained new knowledge but also explored the future of the legal profession, where technology and law go hand in hand, and legal certainty must remain the primary foundation amidst ever-evolving innovation.
